Even if the International Criminal Court will most probably just scrap the complaint filed by Edgar Matobato lawyer Jude Sabio against President Rodrigo Duterte and 11 other officials, they still pursued it because of "black propaganda", said lawyer Glenn Chomg in his Facebook page.

Chong explained that under the Principle of Complementarity, the country has the jurisdiction first hand of all the heinous cases filed within it.



"Ang pinakapuso ng bagong sistemang ito ay ang ideya na, una at higit sa lahat, ang pambansang otoridad o korte ang siyang unang hahawak ng kaso. Ang jurisdiction ng ICC o kapangyarihang humawak ng kaso ay complementary lamang, hindi primary. Ibig sabihin, bago tanggapin ng ICC ang kaso, dapat ay dumaan muna ito sa pambansang otoridad o korte ng bansa dahil ang ICC ay “court of last resort.”

This principle is under the Rome Statute, the treaty signed by 139 countries who agreed to establish the ICC.

The principle is based on the ICC's goal to protect individuals from unjust judicial processes and to save them from double jeopardy.

This also recognizes the respect of the ICC for the sovereignity of each country, and their incapicity to oversee all cases of serious crimes in the world.

He said the complaint filed against the president for the human rights violations he "ordered", will be scrapped because the Philippine judicial system is processing the cases as of the moment.



"Matatandaan na sinampahan na ng kaalyado ni Trillanes si Pangulong Duterte ng impeachment complaint sa Kamara. Ang unang basehan ng kanyang reklamo ay ang extrajudicial killings at Davao Death Squad. Ito rin ang buod ng reklamo ni Sabio sa ICC. Lumalabas na ang kampo ni Trillanes ay nagforum-shopping sa loob at labas ng bansa upang maghanap ng jurisdiction na kakampi sa kanila o maniwala sa kanilang mga istorya."

Chong said that the impeachment case against Duterte was not pursued as the Senate  Hearings proved to have found insufficient evidence to support it.

"Alam nila ang lahat ng ito pero isinampa pa rin nila sa ICC ang reklamo kahit ibabasura lamang ito dahil nga black propaganda ang pakay nila, ipapahiya si Pangulong Duterte at ang bansa sa harap ng mundo, at nagbabakasakaling magbunga ang kanilang forum-shopping," he said.

"Ang lahat ng ito ay bahagi pa rin ng PLAN B," he said.
